September 7th, 2019
Daniel J. Reiter, Esq. was recently published in One on One, a publication of the New York State Bar Association’s General Practice Section.
The article, entitled Defensive Estate Planning with Powers of Attorney: How to Avoid Mayhem, Chaos and Unintended Consequences provides practitioners with practical tips for drafting durable powers of attorney.
“The most powerful legal document currently in force in the United States is its Constitution. The Durable Power of Attorney your client executed last Tuesday comes in a close second,” writes Mr. Reiter. “The power of attorney is a document that must be drafted with great care and forethought. It is subject to abuse and misuse. Short-sighted planning can result in unintended consequences, mayhem, and chaos. It increases the chances of litigation and disputes.”
